This worksheet collects the information used to prepare the forms of the New York State Uniform Uncontested Divorce Packet (Forms UD-1 through UD-12, Rev. 1/20/26) for filing in the Supreme Court. No preparation fee is charged at this time. Court filing fees are paid separately to the County Clerk. No account is required to begin.

Upon commencement of a divorce action, both parties are bound by automatic orders which remain in effect until the judgment of divorce is entered or the action is dismissed. Among them:
ORDERED: Neither party shall transfer, encumber, assign, remove, withdraw or in any way dispose of, without the consent of the other party in writing, or by order of the court, any property (including, but not limited to, real estate, personal property, cash accounts, stocks, mutual funds, bank accounts, cars and boats) individually or jointly held by the parties, except in the usual course of business, for customary and usual household expenses or for reasonable attorney's fees in connection with this action.
The disposition of any residence is therefore addressed before the papers are prepared. Failure to comply with the automatic orders may be deemed a contempt of court.

Enter the following as it will appear on the Summons with Notice (Form UD-1) and the Sworn Affirmation of Plaintiff (Form UD-6). The spouse who files is the Plaintiff; the other spouse is the Defendant. Items (a), (b) and (c) are required. Any other item left blank may be completed later. Where a microphone appears beside an item, the entry may be spoken.
Part 4 asks the residency requirement (Domestic Relations Law § 230), whether there are children of the marriage under 21, and whether the Defendant will sign. The forms are then prepared. Pro Se Network does not give legal advice.
Procedure
- Complete Parts 1 through 4. Part 1 concerns the marital residence. Part 3 collects the names, addresses and marriage information entered on the forms. Part 4 asks residency, children and grounds. Approximately five (5) minutes.
- Requirements. An uncontested divorce in New York requires that the residency requirement of Domestic Relations Law § 230 be met, that both parties consent, and, for this service, that there be no children of the marriage under the age of 21. If a requirement is not met, you are so informed and referred to further assistance.
- Preparation of the forms. The nine (9) forms of the Uncontested Divorce Packet are completed from your answers. No preparation fee is charged at this time. Court filing fees are paid separately to the County Clerk. Court fees are set by the court: $210.00 for the index number, with further fees for the Request for Judicial Intervention and the Note of Issue, payable to the County Clerk.
- Signature, filing and service. Sign where indicated. The affirmations (UD-3, UD-5, UD-6, UD-7, as revised 1/1/24) are signed under the penalties of perjury pursuant to CPLR 2106; a notary is not required. File with the County Clerk of the county you designate and serve the Defendant. Instructions accompany the forms. Records held by this service may be deleted by you at any time.
